Overview
These Terms of Service and Conditions Générales de Vente (“Terms” or “CGV”) govern the use of floavi.com and all purchases made through the website.
The website and online store are operated by MA-SENIOR, trading under the brand name FLOAVI (“FLOAVI”, “we”, “us” or “our”). FLOAVI offers summer lifestyle, inflatable pool and outdoor leisure products through its online store.
Our store is powered by Shopify, which enables us to provide the website, checkout and related e-commerce services. However, all sales made through floavi.com are concluded directly between the customer and MA-SENIOR / FLOAVI.
By visiting the website, creating an account, placing an order or purchasing a product, you agree to these Terms, our Privacy Policy, Shipping Policy and Refund Policy.
These Terms are governed by French law, without limiting any mandatory consumer rights available to customers under the laws of their country of residence.

These Terms apply to consumer purchases made through floavi.com.

Where a customer account is created, you are responsible for keeping your account credentials confidential and for any activity carried out through your account.
You may not use the website for fraudulent, unlawful or unauthorized purposes.

FLOAVI sells summer lifestyle products, including inflatable pools and outdoor leisure products.
The essential characteristics of each product are described on the relevant product page. Customers are responsible for reviewing the product description, dimensions, usage information, safety information and any included instructions before ordering or using a product.
We make reasonable efforts to display product images, colors and details accurately. However, colors and appearance may vary slightly depending on the customer’s screen, device settings or lighting conditions.
We may update product descriptions, discontinue products or limit product availability where reasonably necessary. Any changes will not affect orders already confirmed by us.
Products must be used only for their intended purpose and in accordance with any product instructions or safety warnings supplied with them.
5. Prices, Taxes and Charges
Prices displayed on floavi.com are shown in the currency indicated on the website or during checkout.
The total price payable before order confirmation will include:

any other clearly disclosed charges.
For orders delivered outside the European Union, customs duties, import taxes or local charges may apply depending on the destination country. Unless expressly stated otherwise at checkout, such charges are the customer’s responsibility.
We may modify product prices at any time. Price changes do not affect orders that have already been accepted and confirmed.
In the event of an obvious pricing error, we may cancel the affected order and refund any amount already paid.
6. Orders and Contract Formation
Products displayed on floavi.com constitute an invitation to place an order and do not constitute a binding offer by FLOAVI.
When you submit an order, you make an offer to purchase the selected products at the stated price.
Before submitting your order, you are responsible for checking:

An order becomes binding only when:

If an order is cancelled after payment has been collected, the amount paid will be refunded using the original payment method, unless otherwise expressly agreed.
Products purchased through floavi.com are intended for personal or household use unless otherwise agreed in writing.
7. Payment
Payment is due in full at the time the order is placed.
Payments may be processed using Shopify Payments or other payment methods made available during checkout, which may include major credit and debit cards and local payment options.
Payment information is processed securely by our payment providers. FLOAVI does not store full payment card numbers.
You represent that you are authorized to use the payment method supplied for your order and that the payment information provided is accurate.
Where a payment is refused, reversed or identified as potentially fraudulent, we may suspend or cancel the relevant order.
8. Shipping and Delivery
Delivery destinations, estimated delivery times and available shipping methods are described in our Shipping Policy and, where applicable, during checkout.
FLOAVI currently ships primarily to customers in the United States, subject to product and destination availability.
Before the customer is bound by the order, the delivery date or estimated delivery period applicable to the purchase will be communicated through the product page, checkout or Shipping Policy.
Delivery times are estimates unless a specific binding delivery commitment is expressly stated. Delivery may be affected by circumstances outside our reasonable control, including customs procedures, weather events, carrier disruption or incorrect delivery information supplied by the customer.
Transfer of Risk
For consumers protected under French consumer law, the risk of loss or damage to products transfers to the customer only when the customer, or a third party designated by the customer other than the carrier, physically takes possession of the products.
If the customer independently chooses a carrier not proposed by FLOAVI, risk may transfer upon delivery of the product to that carrier in accordance with applicable law.
If a parcel arrives damaged, incomplete or visibly opened, the customer should document the condition of the parcel and contact us promptly at support@floavi.com.
9. Right of Withdrawal for Eligible Consumers
Consumers who benefit from a statutory right of withdrawal under applicable law, including consumers residing in France or the European Union, may withdraw from an eligible distance purchase without providing a reason within 14 days from the date on which the customer, or a third party designated by the customer other than the carrier, receives the product.
For an order containing several products delivered separately, the withdrawal period begins when the final product is received.
Exercising the Right of Withdrawal
To exercise the right of withdrawal, the customer must inform us of the decision to withdraw before the 14-day period expires by sending a clear written statement to:

The customer may use the withdrawal form included in Section 10 below, but this is not mandatory.
Returning Products After Withdrawal
After notifying us of withdrawal, the customer must return the relevant product without undue delay and no later than 14 days after communicating the withdrawal decision.

Unless the product is defective, non-conforming, or we state otherwise, the direct cost of returning a withdrawn product is borne by the customer.
The customer is responsible only for any reduction in product value resulting from handling beyond what is necessary to establish the nature, characteristics and proper functioning of the product.
Refund After Withdrawal
Where the right of withdrawal is validly exercised, FLOAVI will refund all sums received from the customer for the withdrawn product, including the cost of standard delivery originally offered for that order.
If the customer selected a more expensive delivery method than the standard delivery option offered, we are not required to reimburse the additional delivery cost.
Refunds will be made without undue delay and no later than 14 days after we are informed of the customer’s withdrawal decision. For product sales, we may delay reimbursement until we have received the returned product or until the customer provides proof of shipment, whichever occurs first.
Refunds will be issued using the same payment method used for the original purchase, unless the customer expressly agrees to another method that does not cause additional fees.
Withdrawal Exceptions
The right of withdrawal does not apply where an exception provided by applicable law applies, including, where relevant:

goods made to the customer’s specifications or clearly personalized;

sealed goods that are not suitable for return for health-protection or hygiene reasons and that have been unsealed after delivery;

goods that become inseparably mixed with other items after delivery;
-
any other statutory exception applicable to the product concerned.
Any applicable exception will be clearly disclosed on the relevant product page where necessary.

11. Refund Policy and Voluntary Returns
Any voluntary return, exchange or refund rights offered in addition to statutory consumer rights are described in our Refund Policy.
Nothing in our Refund Policy limits or excludes:

the statutory right of withdrawal where applicable;

the legal guarantee of conformity;

the legal guarantee against hidden defects;

any other mandatory consumer rights.
12. Defective, Damaged or Non-Conforming Products
If a product is damaged on arrival, defective, missing parts or materially different from its description, contact us at support@floavi.com and include:

photographs or video showing the issue where reasonably possible.
Where the product is covered by a statutory guarantee, FLOAVI will handle the claim in accordance with applicable consumer law and without charging the customer costs that the seller is legally required to bear.
13. Legal Guarantee of Conformity and Hidden Defects — French Consumers
For consumers protected under French consumer law, the legal guarantees below apply independently of any commercial warranty or voluntary refund policy.
Mandatory Notice — Garantie légale de conformité
Le consommateur dispose d’un délai de deux ans à compter de la délivrance du bien pour obtenir la mise en œuvre de la garantie légale de conformité en cas d’apparition d’un défaut de conformité. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité et non la date d’apparition de celui-ci.
Lorsque le contrat de vente du bien prévoit la fourniture d’un contenu numérique ou d’un service numérique de manière continue pendant une durée supérieure à deux ans, la garantie légale est applicable à ce contenu numérique ou ce service numérique tout au long de la période de fourniture prévue. Durant ce délai, le consommateur n’est tenu d’établir que l’existence du défaut de conformité affectant le contenu numérique ou le service numérique et non la date d’apparition de celui-ci.
La garantie légale de conformité emporte obligation pour le professionnel, le cas échéant, de fournir toutes les mises à jour nécessaires au maintien de la conformité du bien.
La garantie légale de conformité donne au consommateur droit à la réparation ou au remplacement du bien dans un délai de trente jours suivant sa demande, sans frais et sans inconvénient majeur pour lui.
Si le bien est réparé dans le cadre de la garantie légale de conformité, le consommateur bénéficie d’une extension de six mois de la garantie initiale.
Si le consommateur demande la réparation du bien, mais que le vendeur impose le remplacement, la garantie légale de conformité est renouvelée pour une période de deux ans à compter de la date de remplacement du bien.
Le consommateur peut obtenir une réduction du prix d’achat en conservant le bien ou mettre fin au contrat en se faisant rembourser intégralement contre restitution du bien, si :
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d’enlèvement du bien non conforme, ou s’il supporte les frais d’installation du bien réparé ou de remplacement ;
4° La non-conformité du bien persiste en dépit de la tentative de mise en conformité du vendeur restée infructueuse.
Le consommateur a également droit à une réduction du prix du bien ou à la résolution du contrat lorsque le défaut de conformité est si grave qu’il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n’est alors pas tenu de demander la réparation ou le remplacement du bien au préalable.
Le consommateur n’a pas droit à la résolution de la vente si le défaut de conformité est mineur.
Toute période d’immobilisation du bien en vue de sa réparation ou de son remplacement suspend la garantie qui restait à courir jusqu’à la délivrance du bien remis en état.
Les droits mentionnés ci-dessus résultent de l’application des articles L. 217-1 à L. 217-32 du Code de la consommation.
Le vendeur qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d’un montant maximal de 300 000 euros, qui peut être porté jusqu’à 10 % du chiffre d’affaires moyen annuel, conformément à l’article L. 241-5 du Code de la consommation.
Le consommateur bénéficie également de la garantie légale des vices cachés en application des articles 1641 à 1649 du Code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le bien est conservé ou à un remboursement intégral contre restitution du bien.

14. Product Use and Safety
Customers must use products in accordance with the product description, intended use, instructions and safety warnings supplied with the product.
For inflatable pools and outdoor leisure products, customers are responsible for appropriate setup, adult supervision where children are present, proper maintenance, safe storage and compliance with any relevant warnings.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for bodily injury caused by negligence, fraud, gross misconduct or breach of mandatory consumer protections.
15. Intellectual Property
All content available on floavi.com, including the FLOAVI name, logos, text, product photographs, graphics, layouts, videos, designs and website content, is owned by or licensed to MA-SENIOR / FLOAVI and is protected by applicable intellectual property laws.
You may access and use the website for personal, non-commercial shopping purposes only.
You may not reproduce, copy, distribute, modify, publish, scrape, sell, commercially exploit or create derivative works from any content on our website without our prior written permission, except where permitted by law.
Shopify’s trademarks, software and related materials remain the property of Shopify or its licensors.
16. Third-Party Tools and Links
Our website may contain links to third-party websites, payment providers, social-media platforms or other tools made available through Shopify or independent service providers.
We do not control third-party websites or their terms, privacy practices, products or services. Accessing a third-party website is at your own discretion and subject to that third party’s applicable terms.
Complaints or questions relating to a third-party product or service should be addressed to the relevant third party, unless the issue relates directly to a product purchased from FLOAVI.
17. Relationship With Shopify
FLOAVI is powered by Shopify, which provides the e-commerce infrastructure enabling us to operate our online store.
However, any product purchased through floavi.com is sold directly by MA-SENIOR / FLOAVI, not by Shopify.
Shopify is not the seller of FLOAVI products and is not responsible for product fulfilment, customer service, product conformity, refunds, warranties or disputes relating to purchases made from FLOAVI, except where Shopify has its own obligations under applicable law.
18. Personal Data and Privacy
Personal data collected through floavi.com is processed in accordance with our Privacy Policy:
Because our store is hosted by Shopify, certain personal data may also be processed by Shopify and relevant service providers to enable checkout, payment processing, fraud prevention, hosting, analytics and delivery of the services.

Consumer Mediation
In accordance with French consumer law, where a consumer dispute has not been resolved after a prior written complaint submitted directly to FLOAVI, the consumer may use a consumer mediation service free of charge.
The consumer may also bring a claim before any competent court in accordance with applicable law.
25. Governing Law and Jurisdiction
These Terms are governed by French law.
For consumers, this choice of law does not deprive the customer of any mandatory protection provided by the law of the country in which the customer habitually resides, where such protection applies.
In the event of a dispute, the customer may seek an amicable resolution through customer service and, where applicable, consumer mediation before bringing the matter before a competent court.
Nothing in these Terms requires a consumer to bring proceedings only before a court in France where mandatory consumer jurisdiction rules permit proceedings elsewhere.
26. Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, business practices, website functionality or legal obligations.
The version applicable to an order is the version accepted by the customer at the time the order is placed.
The current version of these Terms will remain available on floavi.com with its effective date.
27. Severability
If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision will apply only to the extent permitted by law or will be severed where necessary.
The remaining provisions will continue in full force and effect.
